{"id":1343,"date":"2016-04-21T16:00:25","date_gmt":"2016-04-21T16:00:25","guid":{"rendered":"http:\/\/scotsindependent.scot\/?p=1343"},"modified":"2016-04-21T16:00:25","modified_gmt":"2016-04-21T16:00:25","slug":"tuc-releases-legal-opinion-on-eu-referendum","status":"publish","type":"post","link":"https:\/\/scotsindependent.scot\/?p=1343","title":{"rendered":"TUC releases legal opinion on EU Referendum"},"content":{"rendered":"<p>TRADE UNION GIANT RELEASES LEGAL OPINION ON EU REFERENDUM<\/p>\n<p>MEP ALYN SMITH AND CHRISTINA MCKELVIE HIGHLIGHT EU ROLE IN WORKERS\u2019 RIGHTS<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft  wp-image-1345\" src=\"https:\/\/scotsindependent.scot\/wp-content\/uploads\/2016\/04\/Alyn_Smith-300x300.jpg\" alt=\"Alyn_Smith\" width=\"188\" height=\"188\" srcset=\"https:\/\/scotsindependent.scot\/wp-content\/uploads\/2016\/04\/Alyn_Smith-300x300.jpg 300w, https:\/\/scotsindependent.scot\/wp-content\/uploads\/2016\/04\/Alyn_Smith-150x150.jpg 150w, https:\/\/scotsindependent.scot\/wp-content\/uploads\/2016\/04\/Alyn_Smith.jpg 650w\" sizes=\"(max-width: 188px) 100vw, 188px\" \/>Alyn Smith MEP and the SNP\u2019s Christina McKelvie have highlighted an independent legal opinion commissioned by the Trade Union Council (TUC) that lists the workers\u2019 rights most at risk in the event of Brexit.<\/p>\n<p>Michael Ford QC\u2019s legal opinion suggests that, based on past history and extant policy documents, the rights most vulnerable to repeal are limits on working hours, protections for agency and part-time workers, and the right to collective consultation, including the right for workers\u2019 representatives to be consulted if major changes are planned that will result in redundancies.<\/p>\n<p>Workers would no longer be able to seek redress from the European Court of Justice (ECJ), regardless of whether the UK Government retained EU-guaranteed worker protections.<\/p>\n<p>Alyn, a co-signatory to the European Trade Union Confederation\u2019s campaign to promote trade union rights as human rights, said:<\/p>\n<p>\u201cScotland has a long history of brave, groundbreaking trade unionism and collective action, where people fought to gain rights that would protect us all in the workplace.<\/p>\n<p>\u201cAs a lawyer to trade myself, I think this is a tremendously important piece of work from Michael Ford QC. Just because a UK government outside the EU\u00a0<em>could<\/em>\u00a0keep the same rights, doesn\u2019t mean it would. Meanwhile, workers would have a sword of Damocles over their heads the entire\u00a0time, with no redress from the ECJ.<\/p>\n<p>&#8220;The EU has long been an ally for Scotland in our struggle to protect workers&#8217; rights.
